This position will have the opportunity to provide critical support to various aspects of the business, focusing on privacy and data security.

The Corporate Counsel's primary focus will be providing timely and competent day-to-day legal services on all privacy matters, including cutting edge privacy projects such as connected car, electric vehicles, frictionless travel, franchisee privacy matters, artificial intelligence and other projects privacy matters affecting our global business worldwide. This position will advise on privacy and related laws affecting commercial transactions; advising on international transfer of data; connected car programs and data management strategies; providing regulatory and general legal compliance advice; advising on information security incidents; and effectively coordinating with outside counsel resources.  The position will also work closely with Enterprise Mobility’s global legislative affairs team on privacy and data security issues.

This position will provide advice and support at the corporate and local operation level, through contract negotiation, review and drafting, regulatory review, drafting, and compliance, short and long-term legal risk assessment, meaningful partnership and collaboration with the business on strategic legal initiatives, training and managing outside counsel.

This role will require someone that can think through problems, navigate the legal and regulatory environment, and find ways to facilitate all this change. The successful candidate will have the opportunity to help develop a practice area while also collaborating with business stakeholders and colleagues in the Legal Group, in their areas of expertise, in Europe, the UK and the North America, working on projects globally as part of these cross-departmental functional teams.  The selected individual must be collaborative, creative, efficient, personable and results-oriented – with outstanding oral and written communication abilities and the ability to work seamlessly in a fast-paced, team environment.

This position is located at our Corporate Headquarters in Clayton, MO, with a hybrid schedule (4 days in office).

• Manage and assist operations, sales and supply chain clients with resolving all privacy and data security legal issues pertaining to various corporate, transactional, and regulatory matters in a manner consistent with the organization’s business philosophy and strategy, and in compliance with legal and regulatory requirements.
• Clearly communicate or present (in writing or verbally) and advise decision makers on the risks and benefits of negotiating options, contractual provisions, and taking various other actions with potential legal impact.
• Monitor and provide timely and accurate interpretations of the various laws, regulations, and judicial developments affecting the organization’s businesses to senior management and operating personnel; keep them apprised of the types of action that require legal consideration and provide internal guidance regarding potential legal risk and compliance obligations.
• Provide ongoing strategic planning, guidance and consultation regarding potential and actual disputes.
• Prepare best practices and present training to various personnel throughout the organization.
• Assume lead role in structuring, drafting, reviewing, and negotiating business-critical contracts and ensuring they properly protect the organization’s interests and objectives.
• Partner with assigned functional areas and operating units to help drive the organization’s business model and execute its strategies.

Minimum:

• Must be authorized to work in the United States and not require work authorization sponsorship by our company for this position now or in the future
• Juris Doctorate from accredited law school or international equivalent from an accredited law school 
• Strong knowledge of US, Canadian, European and other international privacy and marketing laws, rules and regulations, including CCPA, GDPR, PIPEDA, CAN-SPAM, CASL, state security breach and data protection laws, and PCI-DSS
• Relevant experience in providing privacy-related legal advice on proposed business transactions, including reviewing and drafting contracts or contractual language with vendors and business partners
• Five (5) or more years of privacy or similar regulatory or consumer protection experience or transactional experience (with a minimum of four (4) years of substantive privacy and data security work) in a business law firm or in a corporate law department with a proven record of professional excellence and achievement
• Significant research and transactional law experience, including drafting and negotiating complex contracts
• Broad generalist skill set with the ability to independently research and analyze issues;
• License qualified or admitted to practice law in at least one jurisdiction, with the ability to qualify with the Missouri state bar
• Intermediate level of proficiency with Microsoft Office Products (i.e. Excel, Word, PowerPoint, and Outlook)

Preferred:

• Litigation and/or litigation management experience
• Seven (7) or more years of privacy or similar regulatory or consumer protection experience or transactional experience
